1. Acceptance of Terms
By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.
2. Description of Service
Manifest: Affirmations is a mobile application designed to help users with their personal affirmation and manifestation practice. The App provides:
- Tools to create and organize affirmations
- Session modes for practicing affirmations
- Background audio tracks for meditation
- Journaling features for reflection
- Progress tracking and statistics
- Optional premium features via subscription
3. Eligibility
You must be at least 13 years old to use the App. By using the App, you represent that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are under 18, you represent that you have your parent or guardian's permission to use the App.
4. User Accounts
The App does not require account creation. Your data is stored locally on your device and, if enabled, synced via your Apple iCloud account. You are responsible for maintaining the security of your device and Apple ID.
5. User Content
Ownership
You retain full ownership of all content you create in the App, including affirmations, categories, journal entries, and voice recordings. We do not claim any ownership rights over your content.
Responsibility
You are solely responsible for the content you create. You agree not to create content that:
- Violates any applicable laws
- Infringes on others' intellectual property rights
- Contains malicious code or harmful content
6. Free and Premium Features
Free Tier
The following features are available free of charge:
- Unlimited Affirmations
- 26 Spiritual Audio Tracks
- Manifestation Journal
- Streaks & Progress
- iCloud Sync
- Export Your Data
- Home & Lock Screen Widgets
- All background audio tracks
Premium Subscription
Premium features are available via subscription:
- Monthly: $4.99 USD per month
- Yearly: $29 USD per year (save 51%)
Premium features include: record custom affirmations in your own voice, subliminal audio layering for deeper impact, advanced statistics and insights, upload your own audio tracks (up to 10), smart reminders based on your patterns, session templates for quick starts, export to csv for external analysis.
Free Trial
New subscribers may be eligible for a 7-day free trial of Premium features. If you do not cancel before the trial ends, you will be charged for your selected subscription plan.
7. Subscriptions and Billing
Payment
Subscriptions are billed through your Apple ID account. By subscribing, you authorize Apple to charge your payment method on a recurring basis.
Auto-Renewal
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription in your Apple ID settings.
Price Changes
We may change subscription prices at any time. Price changes will not affect your current billing period but will apply upon renewal. We will notify you of price changes in advance.
Refunds
All purchases are processed by Apple. Refund requests should be directed to Apple at reportaproblem.apple.com. We cannot process refunds directly.
Apple's Standard EULA
If you downloaded Manifest: Affirmations from the Apple App Store, your use of the App is also subject to Apple's Standard End User License Agreement (EULA), available at: apple.com/legal/internet-services/itunes/dev/stdeula.
In the event of any conflict between these Terms and Apple's EULA regarding App Store purchases, Apple's terms shall govern.
8. Audio Content
The App includes audio tracks licensed from Pixabay under the Pixabay Content License. These tracks are:
- Free to use for commercial and non-commercial purposes
- Provided for use within the App only
- Not to be redistributed, sold, or claimed as your own work
Audio tracks are provided for relaxation and motivational purposes only.
9. Health Disclaimer
IMPORTANT: Manifest: Affirmations is NOT a medical device, treatment, or therapy.
- The App is designed for personal development, motivation, and reflection only
- The App is NOT intended to diagnose, treat, cure, or prevent any disease or health condition
- The 432Hz audio frequencies are for relaxation purposes only and are not medical treatment
- Do NOT use the App as a substitute for professional medical advice, diagnosis, or treatment
- Always consult qualified healthcare professionals for medical advice
- If you experience any health concerns, seek professional medical help immediately
10. Intellectual Property
The App, including its design, features, code, graphics, and branding (excluding user content and licensed audio), is owned by us and protected by intellectual property laws. You may not:
- Copy, modify, or create derivative works of the App
- Reverse engineer or decompile the App
- Remove any copyright or proprietary notices
- Use our trademarks without permission
11. Prohibited Uses
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the App's functionality
- Use automated systems to access the App
- Share your subscription access with others
12. Service Availability
We strive to keep the App available at all times but do not guarantee uninterrupted access. We may:
- Temporarily suspend access for maintenance or updates
- Modify or discontinue features with reasonable notice
- Discontinue the App entirely with 30 days' notice
We are committed to not removing core features or deleting user data without notice.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- The App is provided "AS IS" without warranties of any kind
- We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability for any claims arising from your use of the App shall not exceed the greater of $50 USD or the amount you paid us in the 12 months preceding the claim
14. Indemnification
You agree to indemnify and hold harmless the App developers from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App or violation of these Terms.
15. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law. You agree to waive any right to participate in class action lawsuits against us.
16. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the updated Terms.
17. Termination
You may stop using the App at any time. We may terminate or suspend your access to the App if you violate these Terms. Upon termination, you retain access to your locally stored data and may export it before uninstalling.
18. Governing Law
These Terms are governed by applicable law. Any legal proceedings shall be conducted in the appropriate jurisdiction.
19. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
